Rental Terms & Conditions


By confirming its reservation and without further notice, the guest (the “Guest”) acknowledges and agrees that he/she has read, understands and agrees to the rental guidelines contained herein and agrees to rent the Vacation Property hereby known as (the “Property”) in accordance with the following terms and conditions. The online reservation confirmation constitutes a contractual agreement between the Guest (and all Guest invitees), and AZRNR offered by Equity Arizona Real Estate, LLC (hereby referred to as AZRNR) to rent the premises described in this listing for the period of time, and at the rental rates confirmed on the confirmation statement and upon all of the terms and conditions contained herein. Guest agrees to execute this Agreement where indicated at the time of booking. If Guest abstains from exercising the Terms of the Agreement, Guest must do so in writing, no less than 7 days prior to the scheduled date of arrival and any refunds shall be determined as outlined per this agreement.
GENERAL INFORMATION. A starter supply of consumable supplies such as paper goods and soaps are provided; please bring additional if you feel this will not be adequate. Linens, pillows, blankets, bedspreads, comforters and a reasonable number of bath towels are provided for each guest. All beds will be made upon check-in and the home shall be clean and prepared upon Guests arrival.
RENTER REQUIREMENTS: The Guest understands that AZRNR rents to responsible adults over the age of 25 only unless otherwise outlined in the property listing. Any persons under the age of 18 must be accompanied by a parent or guardian, unless the Property Owner, or its specified agent, has provided prior written approval. Any reservation obtained under false pretense will be subject to forfeiture and all rents and deposits may be retained by AZRNR.
OCCUPANCY: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit cardholder. This person is considered to be the Guest occupying the property during the rental period and MUST be the primary occupant in the property throughout the rental period. All other persons involved with the rental are considered to be the Guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the Guest only, not the Guest's invitees.  It is important that all guests be accounted for during booking to adequately provide appropriate preparations for all confirmed Guests and Guests invitees. The maximum number of occupants is limited to the number of maximum guests outlined in the property listing. The rental is not intended for parties, events, weddings, ceremonies, receptions, reunions, nor excessive gatherings at any time by anyone and unauthorized people at the home are prohibited. Enforcement of quiet hours are from 10:00 pm – 8:00 am. Exceptions may be made on an individual and case by case basis - please contact AZRNR for prior approval and additional fee structure if this pertains to your intended stay. If any complaints of excessive noise or music, illegal activity, or evidence of a violation of these policies occurs, you may be asked to vacate the premise without any refund of rent or deposits. In addition, any and all damage, disturbance, and cleaning charges, as well as additional unspecified charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the home can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival. Any fine imposed by a governing agency or HOA will be the sole responsibility of the Guest and is not covered under any aspect of the rental damage insurance. Property may not be subleased under any condition.
PAYMENTS: It’s important that Guests adequately secure their travel arrangements and plans prior to confirming their reservation. At the time of booking, 50% of the total confirmed price shall be due. AZRNR only accepts credit card payments with the addition of a 3% transaction processing fee paid by the credit cardholder, no other payment methods are accepted. Guest hereby authorizes AZRNR to automatically charge any remaining balance to the Guests original credit card 30 days prior to the confirmed check-in date. In the event Guest requests to use an alternate credit/debit card for the remaining balance, the request MUST be received by AZRNR no less than 30 days prior to scheduled arrival. If a reservation is made less than 30 days prior to arrival, 100% of the confirmation total will be charged at the time of booking. AZRNR HIGHLY RECOMMENDS guest purchases travel insurance to minimize the financial impact of a cancellation.
CANCELLATIONS: We HIGHLY recommend guests purchase trip insurance following booking. Guest understands the following Cancellation Policy and that any and all refunds are at the sole discretion of the Landlord. In the event, Guest opts not to purchase Travel Insurance, any and all applied discounts shall be void and all rental related rates and fees shall revert back to their original list price. If the guest still wishes to cancel his/her confirmed reservation the following terms shall apply:

  • *Reservations canceled more than 60 days prior to the confirmed check-in date may receive a 50% refund of the amount paid, minus the lesser of a 10% rebooking fee or $250 (whichever is less).
  • *If the guest cancels a reservation more than 30 days but less than 60 days prior to the confirmed date of arrival, the guest may receive a 25% refund of the amount paid, minus the lesser of a 10% rebooking fee or $250 (whichever is less).
  • *Reservations canceled less than 30 days or less prior to the confirmed date of arrival are nonrefundable, even in case of a no show.
  • *No refunds shall be given if Guest checks into the property, or takes occupancy but later wishes to vacate the premises prior to his/her scheduled check out date (conditions apply).
  • *Cleaning fees are always 100% refundable if the reservation has been paid in full and guest cancels their reservation prior to check-in. All reservation changes must be acknowledged in writing. Guest understands that any and all refunds are at the sole discretion of the Landlord. In the event any refunds are granted, any and all discounts shall be void and all rental-related rates and fees shall revert back to the normal, original cost.
TRAVEL INSURANCE: Travel Insurance is available at 6.95% of your total trip cost and offered through iTravelInsured immediately after booking. AZRNR HIGHLY recommends guests purchase trip insurance if there are concerns about loss of job, sick kids, named storms or the potential of death in the family.  For travel insurance coverage information, please contact iTravelInsured at 1‑800‑494‑9907 or when calling from abroad please call 1‑603‑328‑1707

DAMAGE PROTECTION POLICY: A Vacation Rental Damage Protection Policy will be purchased by AZRNR in lieu of an upfront Damage Deposit. This Vacation Rental Damage Protection Policy provides coverage to the owner, on behalf of the renter, for accidental and unintentional damage to the vacation rental unit that may occur during your stay, PROVIDED THAT THEY ARE DISCLOSED TO THE MANAGER PRIOR TO CHECK OUT. Exclusions and limitations may apply. To adequately cover accidental damages caused by Guest and/or Guests invitees, the Vacation Rental Damage Protection Policy shall retain a minimum coverage amount of $1,500. HOWEVER, LIKE A HOTEL, GUEST WILL BE REQUIRED TO PROVIDE AZRNR WITH A VALID CREDIT CARD PRIOR TO CHECK-IN. THIS CREDIT CARD SHALL BE USED ONLY FOR INCIDENTALS AND/OR EXCESSIVE DAMAGES IN EXCESS OF $1,500.00. Both parties agree that if property damages due to accident, negligence or any other cause exceed the coverage amount of the policy, Guest hereby authorizes AZRNR to EITHER a) file a claim with the original booking platform on which the booking was initiated for the reimbursement of cost, or b) charge the credit card on file for the difference. The Vacation Rental Damage Protection Policy shall include but not be limited to, coverage of damage done to the property OTHER THAN REASONABLE WEAR AND TEAR, REPLACEMENT OF KEYS, ACCESS CARDS, GATE/GARAGE REMOTES, ETC., AND MISSING ITEMS. As a condition to the rental of all Vacation Properties, AZRNR reserves the right to charge the Guest’s credit card for any and all uncovered Guest/Invitee caused losses and/or damages sustained to the Vacation Property throughout the duration of their period of occupancy. In the event of any, uncovered Guest and/or Invitee caused loss or damage to the Property, including, but not limited to, excessive cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, unpaid rents plus all applicable taxes, AZRNR is hereby granted the right to charge the Guest's credit card and without contest for the full amount due. As outlined by applicable law, in the event charges exceed the amount covered by the damage protection policy, an itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages. Failure to comply will be processed according to local applicable law.
UPON ARRIVAL: Upon arrival inspect the home for cleanliness. Although we utilize only top-rated cleaning companies, we understand that expectations may vary and on occasion things may get missed. If upon move- in you find cleaning is unacceptable or if you discover any obviously abnormal or broken items, please contact the appropriate vendor outlined in your pre-arrival information and they will remedy your concerns as quickly as reasonably possible. No refunds or considerations are given unless notified of problems within the first 48 hours of check-in.
MAINTENANCE EMERGENCIES: Although AZRNR tries to maintain a higher level of standard in regards to property maintenance, occasionally maintenance issues occur. To limit these issues AZRNR conducts monthly interior and exterior property inspections. The sole purpose of these inspections is to ensure that all aspects of the property remain in proper functioning order and in reasonable condition. Guests will be contacted prior to our preventative maintenance vendor's arrival by either telephone, text message or email. Guest and AZRNR understand that occasional maintenance and or urgent issues may still arise. In the event of a problem getting in the home or if there are more serious concerns or emergent problems with the functionality of the home during your stay, please immediately contact the property manager noted in your pre-arrival information during normal business hours (M-F 8 am-5 pm). If it is after normal business hours, or if there is no answer, please leave a voice message and one of our agents will return your call as soon as reasonably possible. Many issues can be remedied over the phone, however, if a service call is required, we will try to expedite and remediate the situation as quickly as possible. Non-emergent calls will be returned during normal business hours. Please note: If dispatched service personnel determine upon arrival that the maintenance issue was renter caused or due to renter error, a minimum service call of $75.00 may be assessed to the renter's credit card at move out.
MINIMUM STAY: All properties require a minimum stay as stated in the listing details. Longer minimum stays may be required during holidays or high demand periods.
ARRIVAL TIME: Standard check-in is after 4 PM. If you’d like to request an early arrival please contact us within 48 hours of your scheduled arrival to ensure the property is available. Early arrivals must be authorized in writing by management and cannot be guaranteed depending on other guest reservations and the housekeeping schedule. Arriving at the property before your scheduled 4 PM check-in time may incur a fee of up to $50 unless you have specifically received written confirmation for early arrival.
DEPARTURE TIME: Standard check out is at 11 AM. Your prompt departure is appreciated so we can inspect the premises, prepare the property for any incoming guests and begin processing your departure disposition. If you’d like to request a late check out please contact us at least 48 hours prior to your scheduled departure to ensure the property is available and to make the appropriate arrangements. Late Check Outs cannot be guaranteed depending on other reservations and the housekeeping schedule. Unless you have specifically arranged for a late departure time, please plan to vacate the premises by your schedule 11 AM check out time. If you have not arranged for a late checkout, you may be charged $50 for each hour beyond 11 AM you remain on the property, with a one-hour minimum. If the premises have not been vacated by 4 PM, a fee equal to the rental rate of 2 days will be assessed at our highest peak season rate.
RENTAL EXTENSIONS: Providing adequate property availability, Renter may opt to extend their stay by requesting an extension of stay at Extensions shall be granted at the sole discretion of AZRNR and are subject to approval. Renter understands extensions are not guaranteed. Furthermore, Renter understands that vacation rental rates change seasonally and any rental extensions will be adjusted to the current seasonal rate as outlined at
POWER, WEATHER, ACTS OF NATURE AND OTHER RELATED CANCELLATIONS: AZRNR does NOT issue refunds due to acts of nature such as weather, road conditions, snow conditions, power outages, missed flights, delays, forest fires or any other natural or non-natural causes. Please check for current weather and road conditions throughout Arizona prior to arrival. We HIGHLY recommend purchasing Travel Insurance to minimize any financial risk regarding your vacation plans.
CLEANING FEE(s): A cleaning fee is required with all reservations. This fee covers professional housekeepers who thoroughly clean, dust, vacuum, sanitize, wash linens and towels, inspect the property for hidden damages after your departure and appropriately prepare the property for the next guest. Guest(s) are required to follow all checkout procedures detailed in their check out instructions and leave the property in the same general and habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the home shall be charged to the Guest's/Cardholder's credit card as an Additional Cleaning Charge at a rate of $45/hour, with a one-hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped).
LINENS & TOWELS: Bath towels, sheets, pillows, and blankets are provided. Some properties may also provide additional towels for the pool and outdoor use however, we suggest you bring beach or pool towels (if applicable). We do not permit towels or linens to be taken from the premises. DO NOT take the homes linens or bath towels outside unless specifically noted to be used as pool towels.
CHECK OUT REQUIREMENTS: Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $45/hour, with a one-hour minimum:

  1. *Place soiled towels, linens, pillowcases, and bedsheets in the bathtub
  2. *Load and start the dishwasher
  3. *Floors should be in generally good condition and ready to be vacuumed/mopped by the housekeepers
  4. *All household trash, garbage, recycling and/or other discarded items should be properly bagged to avoid spillage/leakage and deposited in the proper outdoor containers unless otherwise noted
  5. *The refrigerator and microwave should be left clean and free of food
  6. *All appliances (stove, oven, BBQ, etc.) should be left in clean condition and free of spills and grease
  7. *All counters and other surfaces should be wiped down and be free of spills and crumbs
  8. *Leave all provided keys, remotes, gate clickers, access cards, mailbox keys, and any other provided items on the kitchen counter
  9. *Shut off power to any electronic device for which you used including stereo, television, lights, fans, etc.
  10. *Confirm you have collected all your personal items and have a safe trip home or to your next destination.

KEYS AND REMOTES: Upon check-in, Guest assumes responsibility for any and all keys and remotes provided. Guests that fail to return community keys, fobs, garage remotes or the like will be charged the cost of the replacement plus a $49 trip charge to obtain replacements, plus any additional programming cost incurred by the landlord.
RENTAL RULES: Guest agrees to abide by the following Rental Rules at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

  1. *SMOKING: Smoking is NOT allowed on the premises of any AZRNR property. This no smoking policy includes the use of E-Cigarettes, candles or other incendiary devices. Despite Arizona's recently passed law that permits the limited use of Medical Marijuana in specific and limited circumstances, the federal Controlled Substance Act (CSA) categorizes marijuana as a Schedule 1 substance and the possession of marijuana is a federal criminal offense. See 21 U.S.C. $ 801 et seq. AZRNR has determined that the use or possession of marijuana, even for medical purposes, may cause a hardship on the Landlord and interferes with the health, safety, welfare and right to peaceful enjoyment of the premises by other residents. As such, the management hereby informs and reminds all tenants that they agree to the Crime Free provision in this contract and, pursuant to that provision and the supporting federal laws, any use of marijuana (medical or otherwise) by the tenant or their guests will result in immediate termination and may lead to legal action. If you have any questions or concerns about this policy, please speak to management. Furthermore, Guests shall be held responsible for any abnormal or unusual smells resulting from smoking, cooking, candles, or the like, as well as evidence indicating that smoking has occurred on the premises and will be charged an additional cost of $500 plus the actual remediation costs and any potential loss of rent upon departure.
  2. *PARKING: Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; HOA and/or applicable fines/towing fees are the sole responsibility of the vehicle owner.
  3. *POOL/HOT TUB (if applicable): No lifeguard is supplied. Guest understands when using the hot tub and/or pool, there is a certain health risk associated with this and agrees to assume all risks associated with the use of such items. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you may be charged for replacement. Remember when not using the hot tub, leave the cover on so hot tub will stay warm. Emergency flotation devices are not toys and should be used only in case of an emergency. Use these items at your own risk.
  4. *CRIMINAL ACTIVITY: You agree to not allow any illegal activity to occur on the premises. AZRNR has the authority to contact law enforcement and report any criminal activity either known or suspected.
  5. *WOOD STOVE, FIREPLACE, CAMPFIRES (where applicable): Firewood is not provided at most properties! When there is a fire, the door/screen must be closed (except to add wood) and the fire MUST be appropriately maintained. Fireplace, wood stove, and/or campfires MAY NOT be used during any burn ban. Call 800-323-BURN for more info. Do not put anything except wood or wood products in the wood stove/fireplace. It is the guests’ responsibility to ensure that all fire restrictions are abided by during your stay. When using a campfire, a charged water hose is to be within 10 ft. The size of the fire should be small enough that embers are not landing outside the fire ring. Fires must be completely extinguished before departure. DO NOT LEAVE CAMPFIRES UNATTENDED!   6. *CABLE/SATELLITE TV, INTERNET & PHONE CALLS: All properties are privately owned and may have different packages for television and internet service. Some properties may only provide internet streaming television, others may provide only cable/satellite, while others may provide both or none at all. Please check the property listing for the amenities provided on the listing page. AZRNR does not guarantee any programs, events or reception and Guest(s) are liable for all charges incurred for any Pay Per View or On Demand service during their stay - if Guest(s) does not use their own credit card for ordering, programming charges plus an additional $20.00 processing fee will be charged to the credit card we have on file. Most homes do not have a landline telephone.
  7. *PRIVATELY OWNED: This home is Privately Owned. Guest acknowledges that if the website listing has included use of amenities such as fireplaces, decks, BBQ’s, swimming pools and the like, that these may be potentially dangerous and involve potential risks if improperly or negligently used, particularly with regard to children and such use is at the GUEST’S OWN RISK. Guest also agrees that even if the property contains such items, the use of these items is STRICTLY prohibited unless specifically stated in the listing description or without prior written consent by AZRNR, the property owner, or the designated agent. Your landlord, AZRNR, nor any of its employees, agents, contractors, vendors, or the like, shall not be held responsible for the loss of personal belongings or valuables of Guest, or any injury or harm to Guest or visitors. By accepting this stay, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. Guest agrees to keep the property and all furnishings in good and clean order and only use appliances for their intended uses. Please check carefully for belongings before you leave. Any items that remain on the premise may be discarded at AZRNR’s sole discretion or may be mailed to you if requested prior to cleaning personnel arriving at the property. In such a case, you will be charged actual shipping cost plus a $25 shipping fee. Pick up may also be arranged at our offices, please contact our us to arrange scheduling if this applies to you. AZRNR is not responsible for lost or stolen items.
  8. *RIGHT OF ENTRY: Guest(s) and invitees understand and agree that they hold only a limited license to enjoy the property and not a lease or any rights to the home in part or whole. At any time during their stay AZRNR, the property owner, or its designated agent may at their sole discretion, cancel this license at any time for failure to comply with these terms or at any time where illegal activities or violations of this agreement are suspect. Furthermore, AZRNR, the property owner, or their designated agent, and/or local law enforcement reserves the right to enter the rental property with just cause to investigate. This may include, but not be limited to, criminal activity, breach of contract, reported disturbances, to check occupancy, check for damage, to make appropriate or emergent repairs, alterations or improvements as we may deem appropriate, or inspect for unapproved pets. In such cases, whereas AZRNR shows the property to prospective purchasers or guests, prior notification will be given.
  9. *SECURITY & SAFETY RISKS: When you rent the property, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the home. There is a digital keypad to which you will be given a temporary code. This code is changed after every guest for security purposes. Children are welcome, but there may be conditions in and around the home that may pose hazardous to them, as well as to adults. You agree that neither your landlord, AZRNR, nor any of its employees, agents, contractors, vendors, or the like, are responsible for any injuries sustained by you and/or your invitees while occupying the premises and does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in original containers outside.

POOL/SPA/JACUZZI/SAUNA ADDENDUM AND LIABILITY RELEASE POOL/SPA/JACUZZI ADDENDUM AND RELEASE: The home you have rented may have a Pool and/or Hot Tub/Jacuzzi. Please read the following terms related to your rental if this applies to your requested property.

  1. *SAFETY CONCERNS: No lifeguard or other safety equipment is provided and you use this amenity at your own risk. This home may not have safety locks, gates or other items that may be recommended or required by City Code for your household makeup. You are responsible for ensuring that the property amenities meet the city codes that may apply to your household regarding pool safety equipment required for households with occupants under 6 (or a different age depending on the city in which the home is located). You are responsible for keeping all gates, and the swimming pool/hot tub area, secured at all times and for providing appropriate supervision of all tenants/occupants/guests.
  2. *OWNER ACCESS AND RESPONSIBILITY: You agree to allow the landlord and/or their agent access at regular times during the rental period to inspect/maintain/repair the pool equipment. The landlord remains liable for the major pool equipment but you will be responsible for anything that is damaged due to your negligence and/or the actions of your occupants/guests.
  3. *LIMITATIONS: You understand that the swimming pool and/or hot tub is strictly an amenity and that the use of this amenity is not guaranteed under the terms of this agreement. Any interruption or non-availability of the use of the swimming pool/hot tub shall not violate any terms of the agreement.
  4. *RELEASE/INSURANCE: By signing this Agreement, you agree that you will use these amenities at your own risk. Your landlord is not responsible for any injuries sustained by you and/or your occupants or guests when using them. You agree to purchase your own insurance in an amount sufficient to cover any claim by any person injured as a result of this any amenity this home provides. Additionally, you agree to indemnify the landlord for any actions resulting from injuries to you and/or your occupants or guests.

PETS (includes service animals): Due to the nature of pets and the risks they pose to the homeowners’ furnishings and personal belongings, pets are NOT generally permitted at most AZRNR Rental Properties unless specifically noted in the property description, or approved by the property owner. PLEASE NOTE: The definition of “Pet” is any living animal, however, unless noted in the property description only dogs shall be recognized and all other “pets” shall be prohibited. Renter and all other guests/invitees of Guest hereby acknowledge that if the tenant has indicated that a dog will be staying on the premises, Guest agrees to pay an additional Pet Rent of $10 per pet, per day in pet rent. All dogs MUST be pre-authorized by management at the time of booking. This agreement shall be construed as a license, not a lease, therefore the pet policy also applies to service animals, however, contact management if a service animal applies to your specific situation. If Guest discloses a service animal to management at the time of booking, an adjustment to the pet rent may be made under certain circumstances, additional documentation may be required. The pet rent will not be refunded if the pet no longer resides on the premises and will not be refundable at the termination of the tenancy. Unauthorized and/or undisclosed pets and/or service animals on the premises may be grounds for immediate eviction and forfeiture of all rental amounts and deposits. Furthermore, a violation of this policy will result in a minimum of $250 per pet, plus the full cost of pet rent for the Guests confirmed rental dates, plus actual damages for the breach. Should a pet and/or service animal be authorized by written consent, Guest hereby agrees to the following:

  1. *OBLIGATIONS OF THE TENANT REGARDING PET(S): Guest agrees to take reasonable steps to control and care for their pet/service animal at all times. They further agree to prevent and report any signs of pet/service animal damage to management immediately. Notification shall constitute Renter's permission for the Landlord to enter the unit to inspect. Renter agrees to keep the home in a clean and debris-free condition and to remove all feces daily in a timely manner. Renter agrees to pay for any treatments to the home including but not limited to carpet cleaning, noticeable pet smells, tick or flea remediation, etc. that are required as a result of their pet/service animal staying on the premises. Renter is fully liable for all behaviors of their pet/service animal and may be evicted as a result of any detrimental activity involving their pet/service animal. Guest agrees to contain the pet/service animal at all times while the Landlord or its agents are on the premises, when the property is being shown, or for any other reason that permits the Landlord access to the premises pursuant to ARS 33-1343. Guest agrees to comply with all state, city, federal or other governmental entity rules, laws or regulations that govern animals including but not limited to pet/service animal registration, licensing, limitation on type or number of animals allowed in these premises. Guest agrees to keep all dogs in an appropriate kennel at all times while the landlord, its agent, or any of its employees, contractors, vendors, or the like, are on the premise, or when the pet/service animal is left unattended. Any violation of this policy will result in a minimum fine of $250 per occurrence, plus the appropriate pet rent for each day of the confirmed stay, plus actual damages for the breach.
  2. *RESTRICTIONS: The Landlord has the right to restrict the breed, size, or species of the pet/service animal permitted on the premises. The Landlord may withdraw their permission for the pet to occupy the premises at any time based on reasonable standards that involve the conduct of the pet/service animal or the Renter.
  3. *REMOVAL OF PET/MEDICAL CARE: Guest agrees to properly care for their pet/service animal and remove pet/service animal when their rental term is ended. If the Renter fails to promptly remove the pet/service animal at departure, Renter agrees that Landlord shall have the right to remove the pet/service animal and make alternative arrangements for that animal's care at the Guest 's sole expense. If the Landlord determines that the pet must be removed because of behaviors involving the pet/service animal, Guest agrees that they will remove that animal immediately if the incident involves a health or safety concern, and not later than 3 days if there is any other reason to require the removal of the pet/service animal. The Guest agrees that the landlord may enter the home without notice to any Guest/invitee if they reasonably feel the animal is in distress, injured and in need of medical care or abandoned. If the animal is determined to need medical care, the landlord may remove the animal immediately and seek medical attention. The Guest is liable for any and all medical costs or costs to board said animal. The Guest releases the landlord from any liability or harm created by or caused to the animal in meeting these stated obligations unless said actions by the landlord are deliberate and intentionally cause harm to the animal. The decision of the landlord to enter and remove the animal or seek medical care is at the landlord’s sole discretion.
  4. *OTHER: Guest acknowledges that the Property Owner is not an insurer of Guest's property and is encouraged to have renter’s insurance to cover any losses or liability that may result from the actions of the pet/service animal. Furthermore, Guest agrees to indemnify and hold harmless AZRNR, the property owner, and its agents from any and all claims, including attorney fees, which the tenant may incur as a result of the negligent or intentional acts of the Guest's or their invitees’ pet/service animal. Guests may be liable for failing to comply with these terms. Property Owner and owners’ agents shall not be liable to Guest, or their invitees, or any third parties for any harm as a result of any pet/service animal issue other than for the intentional act of the Landlord. The landlord may impose or modify rules and regulations involving pet/service animal with a three-day written notice to the Guest and those rules and regulations will become a part of this addendum and fully enforceable, including but not limited to the imposition of fines and the requirement for the Guest to provide and pay for DNA testing of the pet. ​​WARNING: Providing false or misleading information about the pet or any other violation of this addendum is a material violation and may result in legal action.
INDEMNIFICATION & HOLD HARMLESS: While AZRNR and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. AZRNR, Equity Arizona Real Estate, its affiliates, agents, employees, vendors, contractors, and/or its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs), furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. AZRNR, Equity Arizona Real Estate, its affiliates, agents, employees, vendors, contractors, and/or its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify AZRNR, Equity Arizona Real Estate, its affiliates, agents, employees, vendors, contractors, and/or its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

LEGAL PROVISIONS: The parties agree that this Agreement serves as a license to occupy the premises for a period of time as confirmed, it is not a lease and is not governed by any landlord-tenant laws, but may be governed by innkeeper or local license statues. The parties further agree that any occupancy of the property by a Guest and/or Invitees is considered as guest status only and at no time shall obtain any portion of a legal bundle of rights from the property owner. In the event any portion of this Agreement becomes unenforceable due to any state, county, city, HOA, CC&R, law, code, or if the premises are unable to be otherwise occupied due to a casualty event or other issue beyond the Homeowner/Agent’s control, all other aspects of this Agreement shall remain in full effect. Any interruption to the Guest’s stay that is not caused by an intentional act by the Homeowner/Agent shall result in a refund only if the premises are not able to be occupied, and all other inconvenience to Guest shall not be grounds for the termination of this Agreement or for reimbursement of the monies paid by Guest. A pro-rated portion of the fee for the stay shall be refunded in the event that the premises are destroyed or damaged by any casualty event not caused by the Guest. The parties agree that the Guest and/or Guests invitees limited, and temporary, license to the premises may be reneged by the landlord, or its designated agent, at any time for failure to uphold the terms of this agreement. Furthermore, the parties agree to a waiver of any right to a jury trial and that all claims must be filed in the county and state where the rental premises are located. The prevailing party shall be entitled to reasonable attorney fees and costs incurred arising out of any claim of breach of this Agreement. If any part of this Agreement shall become unenforceable or otherwise disapproved of by a court of law, all other provisions of this Agreement shall remain in force and effect. The titles of any paragraph are for the convenience of the readers only. This Agreement may be executed electronically and in counterpart.
